{"id":12734,"date":"2019-12-18T18:06:49","date_gmt":"2019-12-18T18:06:49","guid":{"rendered":"http:\/\/race01.wp\/resources\/cerd-recomienda-a-colombia-recopilar-informacion-fiable-sobre-poblacion-afrodescendiente\/"},"modified":"2023-05-10T11:40:57","modified_gmt":"2023-05-10T11:40:57","slug":"cerd-recomienda-a-colombia-recopilar-informacion-fiable-sobre-poblacion-afrodescendiente","status":"publish","type":"resources","link":"https:\/\/raceandequality.org\/es\/resources\/cerd-recomienda-a-colombia-recopilar-informacion-fiable-sobre-poblacion-afrodescendiente\/","title":{"rendered":"CERD recomienda a Colombia recopilar informaci\u00f3n fiable sobre poblaci\u00f3n afrodescendiente"},"content":{"rendered":"\n<p class=\"justify-text\">The UN Committee\nfor the Elimination of Racial Discrimination (CERD) issued a recommendation to the\nColombian State to adopt an appropriate methodology that ensures \u201caccurate and\ntrustworthy\u201d data statistics are collected on the Afro-Colombian, Black,\nPalenquera &amp; Raizal population, for its next population census. <\/p>\n\n<p class=\"justify-text\">The\nrecommendation was presented alongside more than 40 other recommendations\npublished in a follow-up document to the CERD country review, held on November\n27 and 28 in Geneva, during its 100<sup>th<\/sup> period of sessions.\u00a0 During the review, the Committee carried out\nan extensive review of the level of compliance of commitments carried by the\nState since its last review in 2015 that seek the eradication of any form of\nracial discrimination and racism in the country.<\/p>\n\n<p class=\"justify-text\">With respect to\nthe 2018 Population Census, the Committee expressed concern that the data\npublished on the Black, Afro-Colombian, Palenquera and Raizal Communities\n\u201cdoesn\u2019t accurately reflect\u201d the reality \u2013 given that the final results present\nnearly a 31% decrease in the specified population with respects to the figures\nof the 2005 Census. The CERD Committee stressed that the State must \u201censure\nthat the criteria for self-identification be applied and collected\nappropriately.\u201d<\/p>\n\n<p class=\"justify-text\">This issue was\nprecisely shared to the Commitee by Colombian civil society organizations\nduring the review in November, calling it a \u201cstatistical genocide\u201d against\nAfro-descendant populations. Civil society also stressed that the numbers\npublished in 2018 further deepen the levels of social invisibility for these\ncommunities, and seriously limit the possibility to create public policies that\ncan transform their condition of structural exclusion. <\/p>\n\n<h4 class=\"wp-block-heading\"><strong>Reparations\nto Victims and the Ethnic Chapter<\/strong><\/h4>\n\n<p class=\"justify-text\">Another\nrecommendation from the CERD Committee to the State was to conduct \u201cextensive\nand effective investigations to process and sanction those responsible for\nviolations of human rights committed against members of indigenous and\nAfro-descendant communities affected by the armed conflict. <\/p>\n\n<p class=\"justify-text\">The violence in\nColombia, which continues to persist even after the signing of the Peace\nAccords, has created a context of risk for indigenous and Afro-descendant\ncommunities. In particular, the Committee expressed its concern at the increase\nin paramilitary intrusion into ethnic communities\u2019 territories, the selective\nkillings of Afro-descendant and indigenous community leaders, the increase of\ninternal and mass forced displacement and the lack of protection given to these\ncommunities and the continued recruitment of children by non-state military\nactors. <\/p>\n\n<p class=\"justify-text\">With these\nissues in mind, the Committee urged the Colombian State to implement the\n\u201cnecessary means to ensure an integral reparation to the victims [of the\nconflict,] and to guarantee the distribution of necessary resources.\u201d<\/p>\n\n<p class=\"justify-text\">In addition, the\nCommittee expressed concern about the lack of implementation of the Ethnic\nChapter of the Peace Accords and recommended that it be implemented by way of\nappropriate financing and through the participation of members from indigenous\nand Afro-descendant communities, particularly women. The recommendation then\nadds that \u201cthe processes of leadership selection in indigenous and\nAfro-descendant communities be respected.\u201d<\/p>\n\n<p class=\"justify-text\">In Colombia, the\nsituation of violence, vulnerability and marginalization continue to affect\nethnic communities directly and disproportionately, as seen by the alarming\nlevels of social leaders killed, threatened and displaced from their\nterritories, this according to Colombian human rights defenders. <\/p>\n\n<h4 class=\"wp-block-heading\"><strong>Other\nrecommendations<\/strong><\/h4>\n\n<ul class=\"justify-text wp-block-list\"><li>To ensure that all the cases of\nracial discrimination, xenophobia, hate speech or violence for racial reasons\nbe investigated and that those responsible for these violations be trialed and\ncorrespondingly sanctioned. <\/li><li>To categorize as a crime any\ndiffusion of ideas that promote or justify racial hate and to prohibit\norganizations that promote racial discrimination and\/or instigate it \u2013 as a way\nto comply with the previous recommendations of the Committee,<\/li><li>To increase efforts to prevent\nand eliminate the forced recruitment of indigenous and Afro-descendant children\nand youth by non-state armed actors and to ensure the application of means to\nde-mobilize and reintegrate them into society.<\/li><li>To guarantee protection of\nindigenous and Afro-descendant people against discrimination from State\nentities and government employees, as well as any other person, group or\norganization. <\/li><li>To increase efforts to combat\nthe multiple forms of discrimination to which Afro-descendant and indigenous\nwomen are subject to, in order to ensure that they have adequate and effective\naccess to justice, work, education and health (including reproductive health,)\nregardless of cultural and linguistic differences.<\/li><li>To adopt the necessary measures\nto prevent sexual violence against indigenous and Afro-descendant women and to\nguarantee victim\u2019s access to adequate assistance and methods of protection that\nare both effective and culturally respectful. <\/li><\/ul>\n\n<h4 class=\"wp-block-heading\"><strong>Statement of\nDeclaration<\/strong><\/h4>\n\n<p class=\"justify-text\">Race and\nEquality urges the Colombian State to take note of the recommendations from the\nUN Committee on the Elimination of Racial Discrimination, which seek to\nguarantee respect for the rights of the Afro-descendant and indigenous\npopulation in Colombia.
